Welcome to Dial Hard ("we," "us," "our"). By accessing and using our browser-based calling service ("the Service"), you agree to comply with and be legally bound by these Terms of Service ("Terms"). Please review them carefully.
1. Acceptance of Terms
By using the Service, you expressly acknowledge and agree to these Terms. If you do not agree to all terms stated herein, discontinue use immediately.
2. Service Description
Dial Hard enables users to make international phone calls directly from their web browsers using VoIP (Voice over Internet Protocol). The service is provided on an "as-is" and "as-available" basis.
3. Account Registration and Responsibility
You agree to provide accurate, complete, and current account details. You are responsible for safeguarding your account credentials and are solely liable for all activities on your account. Any unauthorized use must be reported immediately to Dial Hard.
4. Permitted and Prohibited Uses
You agree to use the Service exclusively for lawful, legitimate, and personal or business-related communication. Specifically prohibited uses include but are not limited to:
- Fraudulent or deceptive conduct, including calling international premium-rate or toll numbers without prior written approval.
- Manipulation, "spoofing," or falsification of caller IDs.
- Calls that harass, threaten, or abuse recipients.
- Automated dialing systems or "robocalls."
- Unsolicited telemarketing or spam.
5. Anti-Fraud and Security
Due to known risks associated with fraudulent calling practices, particularly with international toll numbers and premium-rate numbers, the following provisions apply explicitly:
5.1 Prohibited Numbers: You agree not to use the Service for placing calls to premium-rate, international toll, or special-rate numbers unless explicitly permitted in writing by Dial Hard. Calls placed to known premium or high-risk numbers without permission will be considered fraudulent.
5.2 Fraudulent Activity Detection: We actively employ fraud-detection measures, including automated call pattern analysis. You expressly consent to monitoring aimed at detecting, preventing, and mitigating fraud or abuse.
5.3 Account Suspension and Investigation: Any suspected fraudulent activity, misuse, or abuse of the Service triggers immediate account suspension without prior notification. During suspension, you will not have access to funds, credits, or previously placed calls.
5.4 Reporting and Cooperation: If you become aware of suspicious or fraudulent activities involving your account, you must immediately inform us at [email protected]. You agree to fully cooperate with us in any fraud-related investigation.
6. Billing and Payments
You acknowledge your responsibility to pay all charges incurred through your account, including any charges related to fraudulent use stemming from account compromise or negligence.
In case fraudulent or unauthorized use results from your failure to adequately secure your account credentials or devices, you remain fully responsible for incurred charges.
7. Liability and Indemnification
You accept full responsibility and liability for all calls originating from your account. You agree to indemnify, defend, and hold harmless Dial Hard, our affiliates, agents, and employees from any claims, liabilities, costs, damages, or losses arising from your misuse, fraudulent use, negligence, or violation of these Terms.
8. Suspension and Termination
We reserve the right, without liability, to immediately suspend or terminate your access if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service's security or reputation.
9. Modification of Terms and Services
We reserve the right to modify these Terms periodically. Users will receive notice via email or through the Service dashboard. Continued use after notification of changes signifies your acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany, excluding its conflict-of-law rules. Any dispute arising from these Terms will be subject exclusively to the jurisdiction of the competent courts in Brandenburg, Germany.
11. Force Majeure
We shall not be liable or responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, technical failures, telecommunications failures, strikes, civil unrest, governmental actions, or other force majeure circumstances.
12. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, available at www.dialhard.com/privacy. By accepting these Terms, you agree to our practices concerning data collection, use, storage, and disclosure.
13. Severability
If any provision of these Terms is found unenforceable, it shall be severed without affecting the validity or enforceability of the remaining provisions.
