Withdrawal Instruction (Widerrufsbelehrung)

Who this applies to
If you are a consumer — buying for yourself, not for a business or profession — you have a statutory right to withdraw from a contract you conclude with us at a distance: a subscription plan, a credit top-up, or a phone number. This right comes from German law (§§ 312g, 355 BGB), which governs your contract with us wherever you live; it is not limited to customers in the EU. If you live in another country, any additional protection your own law gives you remains unaffected.
The instruction below is the statutory text. It is followed by a short note on how it works in practice at DialHard, and by the model withdrawal form you may use.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Kirill Zhuchkov, DialHard, Kornblumenweg 15, 16348 Wandlitz, Germany, [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
How this works at DialHard
- Starting right away. Calling only works if we start providing the service before the 14 days are up, so before you pay we ask you to expressly request that we start immediately, and to acknowledge that your right of withdrawal ends once the service has been performed in full. Until then, you can still withdraw.
- What "proportionate" means. For a credit top-up, it is the credit you have already spent on calls, at the rates shown when you called; the unspent balance is refunded. For a subscription plan, it is the part of the month that has already run.
- Phone numbers. A number is assigned to you the moment you buy it, and the first month is charged upfront. It is a running service like a plan: if you withdraw within 14 days, you pay only for the days the number was yours and the rest of that month is refunded. After that, you can cancel it at any time.
- Where to send it. An e-mail to [email protected] saying you withdraw is enough. We confirm receipt in writing.
- Not a cancellation. Withdrawal undoes a contract you have just concluded. To end a running plan later, you cancel it as described in section 5.6 of our Terms of Service — at any time, without cost.
